Please read these Terms of Service carefully before using the Premiere Flight platform. By accessing or using Premiere Flight, you agree to be bound by these terms. If you do not agree, do not use the platform.
These Terms of Service ("Terms") constitute a legally binding agreement between you and Premiere Flight ("Premiere Flight", "we", "us", or "our"). They govern your access to and use of the Premiere Flight website, platform, and related services.
By creating an account, making a booking, listing a flight, or otherwise using the platform, you confirm that you are at least 18 years old, have the legal capacity to enter into this agreement, and accept these Terms in full.
Premiere Flight is a marketplace that connects private jet operators with travellers seeking to book empty leg flights. Premiere Flight is not itself an air carrier, charterer, or travel agent. We provide the technology and infrastructure that facilitates transactions between operators and passengers.
All flights listed on Premiere Flight are operated by independent, AOC-certified charter operators. Premiere Flight does not operate, control, or bear responsibility for the operation of any aircraft listed on the platform. The contract for carriage is between the passenger and the operator.
To make a booking or list a flight, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate and complete information when registering and to keep it up to date. Premiere Flight reserves the right to suspend or terminate accounts that contain false information, are used fraudulently, or violate these Terms.
You may not share your account with others or create multiple accounts for the same individual or entity without our prior written consent.
When you confirm a booking on Premiere Flight, you enter into a binding agreement to purchase the flight at the stated price, subject to operator confirmation. Your card details are saved securely via our payment provider, Stripe — no charge is made at the time of booking.
Five days before the scheduled departure, an authorisation hold is placed on your card to verify the funds are available. This is not a charge. Payment is captured only once the flight departs. If the operator cancels before departure, the hold is released immediately and you are not charged.
Prices displayed on the platform are inclusive of Premiere Flight's service fee. No additional charges will be applied after booking unless you request optional extras or the operator's terms explicitly provide for them.
Premiere Flight reserves the right to cancel a booking and release any authorisation hold if we have reason to believe the booking was made fraudulently or in breach of these Terms.
Operator cancellations: If an operator cancels your confirmed flight for any reason, any authorisation hold on your card is released immediately. Because payment is never captured before the flight departs, no charge is made.
Passenger cancellations: If you cancel before an authorisation hold has been placed on your card, no charge applies. If you cancel after the hold has been placed (within 5 days of departure), the hold may still be captured at the operator's discretion. If you fail to arrive for a confirmed flight, the payment may be captured in full as a no-show charge.
Significant changes: If an operator makes a material change to your booking — including a change of aircraft type, departure airport, or departure time of more than 3 hours — you are entitled to cancel at no charge before boarding, with any authorisation hold released immediately. If you choose to board the flight despite the change, you are deemed to have accepted it and payment will be captured at departure as normal.
Premiere Flight allows travellers to submit bids below the listed price for available empty legs. A submitted bid is a binding offer to purchase the flight at the bid price if accepted by the operator.
Operators may accept or decline a bid. If a bid is accepted, it constitutes a confirmed booking subject to the same payment terms as a direct booking — your card is saved at the time of bidding, an authorisation hold is placed 5 days before departure, and payment is captured once the flight departs.
Premiere Flight does not guarantee that any bid will be accepted. Submitting a bid does not create a reservation and does not prevent the flight from being booked by another user at the listed price.
Operators granted access to the Premiere Flight platform agree to:
Premiere Flight reserves the right to suspend or permanently remove any operator from the platform for breach of these obligations, failure to maintain required certifications, or any conduct that undermines the safety or integrity of the platform.
Travellers using the Premiere Flight platform agree to:
Failure to arrive on time or comply with crew instructions may result in the loss of your booking without refund. Premiere Flight accepts no liability for costs arising from a passenger's failure to comply with these obligations.
You may not use the Premiere Flight platform to:
Violation of these prohibitions may result in immediate account termination and legal action where appropriate.
All content on the Premiere Flight platform — including the brand, design, copy, code, and data — is the property of Premiere Flight or its licensors and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any Premiere Flight content without our express written permission. Nothing in these Terms grants you any licence to use our intellectual property beyond what is strictly necessary to use the platform as intended.
The Premiere Flight platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the platform's availability, accuracy, or fitness for a particular purpose.
We do not warrant that flights listed on the platform will be available at the time of booking, that operator information is always current, or that the platform will be free from errors or interruptions.
To the fullest extent permitted by applicable law, Premiere Flight's total liability to you for any claim arising out of or related to these Terms or the platform shall not exceed the amount you paid for the booking giving rise to the claim.
Premiere Flight is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of enjoyment, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
You agree to indemnify, defend, and hold harmless Premiere Flight and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the platform, your breach of these Terms, or your violation of any third-party rights.
These Terms are governed by and construed in accordance with the laws of Belgium. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Belgium, unless applicable consumer protection law in your country of residence requires otherwise.
As a consumer based in the European Union, you may also benefit from any mandatory provisions of the law of your country of residence, and you retain the right to bring proceedings before the courts of your country of habitual residence.
We may update these Terms from time to time to reflect changes in the law, our services, or our business practices. When we make material changes, we will notify you by email or via a prominent notice on the platform at least 14 days before the changes take effect.
Continued use of the platform after changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the platform.
